Terms of Use
These Terms of Use ("Terms") govern your access to and use of luxevietnamtravel.com (the "Site"), operated by Luxe Vietnam Travel ("we", "us" or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Acceptance of terms
By using the Site you confirm that you are at least 18 years old and able to enter into a binding agreement. These Terms apply to all visitors and users. We may update them from time to time, and your continued use after changes are posted constitutes acceptance of the revised Terms.
2. About our service
Luxe Vietnam Travel is an independent travel-design company that plans private, tailor-made journeys within Vietnam. We are not an airline, hotel, cruise line or tour operator. We do not sell airline tickets or process payments on the Site. We prepare proposed itineraries and, at your direction, arrange travel components through vetted, licensed local operating partners. Any contract for travel services is between you and the relevant operator or supplier under their terms and conditions.
3. Informational purpose
All content on the Site is provided for general informational purposes. Itineraries, inclusions, availability and the per-person prices shown are illustrative estimates that change frequently with season, hotel choice, group size and other factors, and they do not constitute an offer or a quote. We confirm a clear, itemized estimate in writing before anything is reserved.
4. Acceptable use
You agree to use the Site only for lawful purposes. You may not interfere with its operation, attempt unauthorized access, scrape content at scale, submit false or another person's information, or use the Site to transmit malware. You agree to provide accurate information when you submit an enquiry.
5. Intellectual property
The Site and its content, including text, photographs, graphics, logos, layout and code, are owned by Luxe Vietnam Travel or its licensors and are protected by intellectual-property laws. You may view and print content for your own personal, non-commercial reference. You may not reproduce, distribute, modify or create derivative works from our content without our prior written permission.
6. Third-party operators and links
Your journey is delivered by independent local operators, accommodations, transport providers and guides. We select partners with care, but we do not control their day-to-day operations and are not liable for their acts or omissions. The Site may link to third-party websites whose content and practices we do not control. Your dealings with any operator, including the terms of any booking and any payment, are governed by that party's terms.
7. Travel risks and responsibility
International travel involves inherent risks, and conditions such as weather, transport schedules and local circumstances can change. You are responsible for ensuring you have valid travel documents, including any required visa, and appropriate travel insurance, and for following the laws and customs of the places you visit. We strongly recommend comprehensive travel insurance for every journey.
8. Disclaimer of warranties
The Site and all content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure, or that any information is complete or current.
9. Limitation of liability
To the fullest extent permitted by law, Luxe Vietnam Travel and its operators will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of the Site or from the acts or omissions of third-party travel suppliers. Our total aggregate liability for any claim relating to the Site will not exceed one hundred US dollars.
10. Indemnification
You agree to indemnify and hold harmless Luxe Vietnam Travel and its operators from any claims, damages, liabilities and expenses, including reasonable legal fees, arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
11. Governing law and jurisdiction
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute arising from or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Lee County, Florida.
12. Termination
We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or for any other reason. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and indemnification, will survive.
13. Severability and waiver
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision.
